When an Arkansas LLC owner dies, inheriting an ownership interest does not always mean inheriting the authority to run the company. Your operating agreement and estate plan can help clarify what happens next.

In theory, yes. A beneficiary deed puts real estate in the hands of the named beneficiary upon the owner’s passing, yet the owner retains full control while living. The trouble is that any misstep in how the document is drafted or recorded, or in how it aligns with the rest of the estate plan, can create issues.

In many cases, no. For an estate of $100,000 or under, the state’s small-estate procedure offers a more streamlined way for families to put assets in order and effect transfers without the burden of a complete probate administration.

Of course, one has to look at the specifics to determine eligibility; things like the nature of the assets in the probate estate, any debts left behind and the family’s own situation will be determinative.

18 of our attorneys are listed in Best Lawyers in America. 3 are recognized in Best Lawyers: Ones to Watch in America, which highlights attorneys in their first ten years of practice. What happens to a home, rental property, or family land when someone passes away?
In Arkansas, the answer depends on how the property is titled, whether an estate plan is in place, and whether debts, liens, or multiple heirs are involved. Probate can also affect who maintains the property, whether it can be sold, and how ownership is ultimately transferred.
