Sri Lankan music copyright violation has a deep, untold, and deeply unhinged history. Since both authors and performers have lacked proper knowledge of intellectual property and music copyright, they have repeatedly been fooled—by each other and by many commercial parties, electronic medias - time and time again.

Performers made the first move in copyright violation by taking musical creations from place to place wherever they could gain the maximum commercial benefit. In many instances, they sold the same popular songs to multiple record labels within a period of less than a single year. This particular unethical practice resulted in multiple sound recordings of the very same song. While these may be called different versions, no country with a respected and properly regulated music industry would allow such a practice.

These recordings cannot be meaningfully distinguished from one another because they are performed by the same artist. Such conduct violates the rights of the author as well as the rights of the first record label that lawfully invested in and produced the original sound recording. This type of infringement cannot be justified by any copyright law that has ever existed or currently exists anywhere in the world.

In most cases, performers initiate a song by requesting a lyricist and a composer to create it. The performer pays both parties to produce the work, but fails to understand that such payment is not a perpetual acquisition of copyright. They hypothetically believe that paying for the creation means they own the creation itself. In reality, copyright ownership does not automatically transfer simply because a fee has been paid.

At the end of the day, the performer is often the one who is ultimately fooled by a record label that purchases the master recording for a one-time payment. Without understanding how to protect their own neighboring rights and commercial interests so they can continue benefiting from their performances for decades, many performers today find themselves deprived of long-term income. Instead of recognizing where the real problem lies, they blame authors and make misguided and irresponsible statements about copyright law.

Copyright administration in Sri Lanka's music industry remains one of the country's most overlooked and misunderstood issues. A lack of public awareness, weak government enforcement, and decades of government and collective institutional inaction have left creators still struggling to protect their rights and receive fair recognition for their work.

In this episode, we examine how successive governments since 1979 have, in my view, failed to establish an effective and transparent copyright administration system. We discuss the creation and operation of collective management organizations, the role of government institutions, and the ongoing challenges faced by authors, composers, performers, producers, and other music rights holders.

The discussion also explores the transformation of Sri Lanka's broadcasting sector during the 1990s, when commercial radio frequencies were introduced. We question whether this transition created an environment in which commercial broadcasters manipulated and enjoyed significant advantages while copyright compliance and accountability remained inadequate. We further examine allegations that music has been commercially exploited for decades without proper licensing, fair remuneration, or meaningful enforcement, leaving creators and rights holders at a disadvantage.

Songs were first widely developed and presented in operas through solos, duets, trios, choruses, and other vocal forms. Over time, many of these operatic works and arias have been performed and recorded by countless artists.

This history helps explain an important principle of copyright law: a performer's rights are generally different from an author's copyright. Unless a performer is also the author or a co-author of the work, they usually cannot decide who may perform that musical work in the future. That authority belongs to the copyright owner of the composition.

Performers, however, are granted neighbouring (related) rights over their performances. These rights can include protection against unauthorized recording, reproduction, distribution, and certain other uses of their performances, as well as the right to equitable remuneration in situations provided by law, such as the public use or broadcasting of commercially released recordings in many jurisdictions.

The copyright owner of the musical work retains the exclusive right to authorize or prohibit uses of the composition, subject to the exceptions and limitations set out in the applicable copyright law.

Why doesn't the singer own the song?
Copyright exists to protect original creative expression. The author writes the words, and the composer creates the music. These are considered original works of authorship.
A singer generally interprets and performs those works rather than creating the underlying composition.
For example:
Lyrics: "Imagine all the people..."
Melody: created by the composer.
A singer performs that song.
The performance may be brilliant and unique, but it does not make the singer the owner of the lyrics or melody.
What rights does a singer have?
Most countries recognize performers' rights (also called neighbouring or related rights). These typically include the right to:
Authorize or prohibit recording of their live performance.
Control the broadcasting or public communication of their recorded performance.
Receive equitable remuneration when recordings are broadcast or publicly performed (depending on national law).
Object to certain unauthorized uses or alterations of their performance in some jurisdictions.
These rights protect the performance, not the musical work itself.
Can a singer own copyright?
Yes, in several situations.
A singer owns copyright if they are also:
the lyricist,
the composer,
or a co-writer.
For example:
Taylor Swift writes lyrics, composes music, and performs many of her songs. She can therefore own copyright as an author/composer in addition to performers' rights.
Similarly, if a singer contributes original lyrics or melody during the songwriting process, they may become a joint author, depending on the applicable copyright law and the facts.
What about the master recording?
Suppose a singer records a song in a studio.
There are two separate rights:
The musical work
Owned by the lyricist and composer (or their publishers).
The sound recording (master)
Usually owned by whoever financed or produced the recording, often a record label or producer, unless contracts state otherwise.
