📣 ART Success Update – Student Visa Refusal Remitted Back to the Department

A quick update from last month that I didn’t get the chance to share.

On 29 June 2026, the Administrative Review Tribunal (ART) decided to remit one of our onshore student visa refusal matters back to the Department of Home Affairs for reconsideration.

This means the Tribunal found that the case should be looked at again. It is a significant outcome for the applicants involved.

For many families, a remittal is a second chance. It allows the Department to reassess the application with fresh eyes, and in many cases, it leads to a positive result.

If you or someone you know has received a student visa refusal, Genuine Student concerns, or a GTE‑related refusal, the ART may still be an option — but strict timelines apply.

Tasmania Nomination Processing – What the Latest Numbers Mean

Tasmania has wrapped up its current round of ROI invitations and will restart once the new nomination allocation arrives from Home Affairs. Current figures show significant demand compared to the limited places remaining:

Demand vs Capacity
• ROIs submitted: 556 (190) and 594 (491)
• Remaining nomination places: only 31 for each subclass

Processing Load
• 281 applications are already lodged and awaiting a decision
• 50 invitations have been issued but not yet converted into applications

Processing Timeline
The oldest nomination application awaiting allocation is from 7 March 2026, which reflects Tasmania’s usual processing queue and does not necessarily indicate a backlog.

This update highlights the competitive environment for Tasmanian nomination and the importance of strong, well‑prepared applications.

📢 Important Update for Student Visa Applicants – the ART can now decide Student visa refusals on the papers, without holding a hearing.

The Migration Amendment (Administrative Review of Student Visa Refusal Decisions) Regulations 2026 has introduced a major change to how Student visa refusals are reviewed.

The Administrative Review Tribunal (ART) can now finalise certain Student visa refusal reviews on the papers, meaning no hearing is required.

However, this does not apply where part of the refusal was based on one or more of the following:

Public Interest Criteria (PIC) 4001, 4003B, 4007, 4010, 4013, 4014, 4017, 4018 or 4020

Any Special Return Criterion (SRC)

In those cases, the usual hearing process will still apply.

⏳ New Response Timeframes
The regulations have also confirmed the deadlines for responding to invitations from the Tribunal for applications to be heard on the papers:

• Written submissions and evidence: 28 days from the date of notification

• Response to adverse information: 14 days from the date of notification

If an applicant does not respond to the submission invitation within 28 days, the ART must dismiss the review application.

These changes apply to:

Review applications lodged from 18 May 2026, and

Applications lodged before this date that have not yet been constituted
