Pool and spa owners are legally responsible for maintaining a compliant safety barrier at all times.

This is true even if no children live at the property.

In Victoria, a fence shared with a neighbour’s property can form part of the safety barrier – but that doesn’t mean shared responsibility.

The tragic case outlined in the Herald Sun article highlights why these regulations are in place.

If your pool or spa is capable of holding more than 30cm of water, it must be registered with the local council – it’s the law.

🛟 A compliant safety barrier must be in place at all times to limit access by children even if no children live at the property.

🛟 For rental properties, the landowner is responsible for registering a pool or spa and maintaining a compliant safety barrier.

🛟 Owners must get their pool safety barrier reinspected every 4 years and lodge a compliance certificate with council.

🛟 Registered practitioners qualified to inspect pool safety barriers include building surveyors, building inspectors and pool inspectors.

The BPC has suspended Gippsland builder Rodney Centra for 11 months over 4 backyard pools that were filled with water without any suitable safety barriers in place.

Centra has also been fined $55,000 for his conduct at sites across Gippsland – in Stratford, Lindenow South, Fernbank and Nambrok.

At the Lindenow South and Fernbank sites, Centra either permitted or failed to prevent the pools being installed and filled with water without a compliant barrier in place.

He also failed to notify the Relevant Building Surveyor at the required mandatory stages during construction to allow inspection of the work.

Pools must have a compliant safety barrier in place at all times to prevent drowning – regardless of whether children live at the property. The landowner must also register the pool or spa with the council.

Centra’s commercial and low-rise demolisher building registrations are not affected by this suspension, which is due to come into effect later this month. Centra has the right to appeal the decision.

If you own a pool/spa in the Mornington Peninsula Shire - be aware the council are now fining ratepayer's whose compliance lodgement is overdue.

Don't get stung! - not only is the fine $452 - it is also applied to EVERY homeowner listed on the rates notice.

ALSO you will still need to pay for a compliance inspection.
Please heed this warning and make sure your compliance deadline doesn't become overdue.
